TERMS AND CONDITIONS OF STAY – MIAMI DE PORTUGAL

1. INTRODUCTION AND SCOPE
These Terms and Conditions govern the rental agreement between the Host (Szabolcs Szilva, operating under NIF 316851655) and the Guest for the temporary accommodation located at Rua Antonio Feu, building Rio à Vista, apartment 4ºB, , 8500-802 Portimão, Portugal, commercially known as “Miami de Portugal”.
By making a reservation, the Guest acknowledges and agrees to these Terms.
2. ACCOMMODATION CONFIGURATIONS
The property is a 2-bedroom apartment. Depending on the booking selection, the Guest is granted access to specific areas only. The Guest agrees to occupy only the option selected at booking:
- The Whole Apartment: Exclusive use of the entire property (2 bedrooms, 2 bathrooms, living room, kitchen, and 2 balconies).
- “Viseu” Option: Exclusive use of the bedroom and bathroom called “Viseu”, plus shared access to the living room, kitchen, and balconies. The “Faro” bedroom and bathroom will be locked and/or inaccessible.
- “Faro” Option: Exclusive use of the bedroom and bathroom called “Faro”, plus shared access to the living room, kitchen, and balconies. The “Viseu” bedroom and bathroom will be locked and/or inaccessible.
Strict Occupancy Rule: Accessing locked/unrented areas without authorization constitutes a breach of contract and will result in an immediate additional charge equivalent to the full apartment rental rate.
3. BOOKING AND PAYMENTS
Payment Terms: Payment Terms:
- To secure a reservation, an immediate payment of 50% of the total booking value is required.
- The remaining balance must be paid 30 days before check-in the latest.
- Payment of the total booking value during the booking process: If 30 days or less remain until the check-in date, 100% payment of the booking value is required.
- The operator of electronic payments and payment cards is Stripe Payments Europe, Ltd., with its registered office at: 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland, registered in Ireland under number 513174.
Currency: All payments must be made in Euros (€).
Invoicing: An invoice can be issued for every stay on request. Guests requiring a NIF (Tax ID) on their invoice must provide it at the time of payment.
4. SECURITY DEPOSIT
A security deposit of 200 € is required prior to check-in to cover potential damages, missing items, or extraordinary cleaning.
This amount have to be paid in advance. After the reservation it will be refunded.
The deposit will be released/refunded within 7 days after checkout, provided the property is inspected and no damages are found.
5. CANCELLATION POLICY
Free Cancellation: Guests may cancel free of charge up to 30 days before arrival.
Late Cancellation: Cancellations made within 30 days of arrival are non-refundable and charged at 100% of the booking value.
No-Show: Failure to arrive without notice results in a 100% charge.
6. MANDATORY GUEST REGISTRATION (SEF/AIMA)
In accordance with Portuguese Immigration Law, we are required to report the entry of all foreign nationals to the Agency for Integration, Migration and Asylum (AIMA/SEF).
Requirement: All guests (including children) must provide valid identification (Passport or ID Card) prior to or upon check-in.
Data Collected: Full name, nationality, birth date, place of birth, and document number.
Failure to Provide: Failure to provide this information allows the Host to refuse entry without refund, as it constitutes a legal impossibility to host.
7. CHECK-IN AND CHECK-OUT
Check-in: From 15:00. The guests check in on their own using the check in instructions.
Check-out: By 11:00 AM.
8. HOUSE RULES & NOISE RESTRICTIONS
Quiet Hours: In compliance with the General Noise Regulation (Regulamento Geral do Ruído), silence must be respected between 23:00 and 07:00. Loud music, parties, or disturbances are strictly prohibited.
No Smoking: Smoking is strictly prohibited inside the apartment. Smoking can result in up to 500 € fee. It is permitted only on the balconies provided ashtrays are used and doors to the apartment are closed.
Pets: Pets are not allowed.
Visitors: Only guests listed on the reservation are allowed overnight.
Keys: Lost keys will incur a replacement fee of 50 € plus the cost of lock replacement if necessary for security reasons.
9. TOURIST TAXES
If applicable by the Municipality of Portimão at the time of stay, a Municipal Tourist Tax (Taxa Municipal Turística) will be charged separately. This is a government levy and is not included in the rental price unless stated otherwise.
10. LIABILITY AND DAMAGES
Host Liability: The Host is not responsible for the loss, theft, or damage of Guests’ personal belongings left in the apartment. The Host is not liable for failures in utility supply water/electricity/internet caused by external service providers.
Guest Liability: The Guest is fully responsible for the safety of the property during their stay. Any damage caused to furniture, equipment, or structure (beyond normal wear and tear) must be paid for by the Guest.
11. COMPLAINTS
In compliance with Portuguese law, this establishment has an Electronic Complaints Book (Livro de Reclamações Eletrónico) available at www.livroreclamacoes.pt.
12. APPLICABLE LAWThese terms are governed by Portuguese Law. Any disputes arising from this contract shall be settled by the courts of the district of Portimão/Faro.
